Competition Terms and Conditions - "GIVE ME MY NAME"
I. Introductory Provisions
i. PETROF, spol. s r.o., ID No.: 62028634, with registered office at Na Brně 1955, Hradec Králové 6, 500 06, registered in the Commercial Register maintained by the Regional Court in Hradec Králové under File No. C 7054 (hereinafter referred to as the "Inviting Party") announces the competition "GIVE ME MY NAME".
II. Basic Information about the Competition (Basic Principle of the Competition)
i. The purpose of the competition is to select a new name for a model P 131 of PETROF upright piano. The competitor whose design is selected by the Inviting Party will be presented with a gift of a PETROF upright piano by the Inviting Party.
ii. The competitor enters the competition by submitting a bid using the official website of the Inviting Party (www.petrof.com), where the basic competition question is found. Proper and complete completion of the competition questions and subsequent submission of the online form is considered the submission of the bid. The competitor is not entitled to reimbursement of costs associated with participation in the competition.
iii. Competitors may submit an unlimited number of bids.
iv. As part of the submission process, each competitor shall be required to select one primary or secondary school, vocational school, elementary art school, conservatory or other similar foreign educational institution ("School") which, in his/her sole discretion, should receive the PETROF piano as a gift from the Inviting Party. It is a condition that the chosen school must be located in the country of which the competitor is a citizen. The school selected by the winner of the competition shall undertake to organise a concert by accepting this donation.
v. The competitor is required to complete a marketing questionnaire during the submission of his/her proposal.
vi. The Inviting Party has the right to reject any and all bids submitted.
III. Place and Duration of the Competition
i. The competition will run from October 10, 2022, to November 10, 2022. A bid submitted after the deadline cannot be included in the competition.
ii. The Inviting Party shall select the most suitable of the bids and announce its acceptance which shall take place on December 1, 2022, by publishing it on the Inviting Party's official website (www.petrof.com).
IV. Conditions of Participation in the Competition
i. The competition is open to anyone who agrees to these terms and conditions.
ii. Only persons over the age of 18 years or persons over the age of at least 12 years, for whom a legal guardian is responsible during the competition, are entitled to participate in the competition.
iii. The competition is open to citizens of selected countries to which the Inviting Party may distribute its products (Annex 1 of the Competition Terms and Conditions).
V. Award
i. By accepting the most suitable bid, a donation contract between the winner and the Inviting Party is concluded, the subject of which is a gratuitous transfer of the ownership of 1 PETROF P 125 M series upright piano from the Inviting Party to the winner. The conclusion of the donation contract according to the previous sentence also entitles the selected school to conclude a donation contract with the Inviting Party, the subject of which is the gratuitous transfer of the ownership of 1 PETROF upright piano of the same model and series, and the corresponding obligation of the Inviting Party (future contract arrangement in favour of a third party).
ii. The two pianos which are the subject of this competition shall be delivered to the winner and the selected school within 6 months of the announcement (the specific delivery time will depend on the place of delivery).
iii. In the case of multiple identical bids, the winning bid shall be the bid of the competitor who submitted his/her bid first.
iv. Winning any prize is conditional upon complying with and fulfilling all the terms and conditions of the competition. The award is not legally enforceable. No rights to any award arising from this competition may be transferred to any other person, nor may any prize be paid in cash or compensated in kind.
VI. Personal Data
i. The competitor grants the Inviting Party consent to the processing of the personal data provided for the purpose of awarding the prize and for marketing and promotional purposes. Consent is granted by the competitor in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) ("GDPR"). The personal data provided shall be processed in the following scope: name, surname, email address, telephone number, home address and other data provided in the communication about the acceptance of the award. The provision of the data represents a condition of the competition. The data administrator is the Inviting Party.
ii. By entering the competition, the competitor grants the Inviting Party permission to publish their name, surname, and country of residence; furthermore, consent to the possible publication of his/her photograph on the website, if the use is related to this competition.
VII. Final Provisions
i. The Inviting Party reserves the right to make decisions on all matters relating to the competition, including changing the rules, interrupting the competition, suspending the competition, terminating the competition or excluding any competitor from the competition without any compensation whatsoever, in particular on the grounds of non-compliance with the competition rules or on the mere suspicion of non-compliance with the competition rules, violation of the legal regulations of the Czech Republic, conduct contrary to good morals or which, in the opinion of the Inviting Party, is likely to jeopardise its legitimate interests, violation of the rules of fair play or other defective conduct on the part of the competitor, such as manipulation of the results of the ranking or other conduct unfairly affecting the results of the competition. The Inviting Party is entitled to make a decision under this clause at any time during the competition until the prizes have been awarded.
ii. These competition rules are complete and binding on all competitors.
iii. These competition rules are valid from October 10, 2022.
